Powers of the members of the force:-

Every member of the force having been so appointed and till such time he remains a member of the force, shall be considered a Police Officer and shall be subjected to such conditions, restrictions and limits as may be determined; and shall have all such powers, special powers, responsibilities, restraints, punishments and protections; and be governed by them, as are applicable to police officers appointed to Uttar Pradesh Police under the Police Act, 1861 or any such other law for the time being in force or under any rules or regulations framed there under, but such conditions , restrictions and limits shall not be contrary to the orders under the Act.

Procedure of arrest:-

(i) the member of the Force shall actually touch or confine the body of the person to be arrested.

(ii) If such person forcibly resists the endeavor to arrest him, or attempts to evade the arrest, the member of the Force may use all means necessary to effect the arrest. In case of use of force it should be minimum, required in that particular situation.

(iii) The person arrested shall not be subjected to more restraint than necessary to prevent his escape.

(iv) The member of the force making the arrest, may search such person, and place in safe custody all articles including weapons, if any other than necessary wearing apparels, found upon him. An inventory of all such articles shall be prepared in the presence of the arrested person and a copy of the inventory duly signed by the witnesses and the person conduction the search, shall be given to the person so arrested after obtaining duo receipt.

(v) Such arrested person as well as the seized articles and its inventory shall be handed over to a local police officer or at the nearest police station without avoidable delay along with a brief note giving the time, date and reasons of arrest.

Procedure of Search:-

Whenever a search of a person and of his belongings is conducted under section 11 of the Act an inventory shall be prepared in the presence of the two respectable witnesses and a copy of the inventory duly signed by the witnesses and the person who conducted the search, shall be given to the person concerned after obtaining due receipt. The property so found on such search, shall also be sent to the police along with the person If nothing is found on such search, a nil inventory statement duly signed shall be sent to the police along with the person.
